Israel is galloping blindfolded to its next war in Palestine - Does anyone care?

The next war will break out in the summer. Israel will give it another childish name and it will take place in Gaza. There's already a plan to evacuate the communities along the Gaza Strip border.

Israel knows this war will break out, it also knows why - and it's galloping toward it blindfolded, as though it were a cyclic ritual, a periodical ceremony or a natural disaster that cannot be avoided. Here and there one even perceives enthusiasm.


It doesn't matter who the prime minister is and who the defense minister is - there's no difference between the candidates as far as Gaza is concerned. Isaac Herzog and Amos Yadlin are saying nothing of course, and Tzipi Livni is boasting that thanks to her no port was opened in Gaza. The rest of the Israelis aren't interested in Gaza's fate either and soon it will be forced to remind them again of its disaster in the only way left to it, the rockets.


Gaza's disaster is dreadful. No mention of it is made in the Israeli discourse and certainly not in the most dumbed down, hollow election campaign there's ever been here. It's hard to believe, but Israelis have invented a parallel reality, cut off from the real one, a callous, unfeeling, denying reality, while all this adversity, most of it of their own making, is taking place a short distance from their homes. Babies are freezing to death under the debris of their homes, youths risk their lives and cross the border fence just to get a food portion in an Israeli lock up. Has anyone heard of this? Does anyone care? Does anyone understand that this is leading to the next war?


Salma lived only 40 days, like the eternity of a butterfly. She was a baby from Beit Hanoun on the northeast of the Gaza Strip, who died last month of hypothermia, after her tiny body froze in the wind and rain that penetrated into the plywood-and-plastic hut she has been living in with her family, since their house was bombed.


"She was frozen like ice cream," her mother said of the last night of her infant's life. UNWRA Spokesman Chris Gunness wrote about Salma last in week in the British newspaper the . Mirwat, her mother, told him that when she was born she weighed 3.1 kilograms. Her three - year - old sister, Ma'ez, is hospitalized due to frostbite.


Ibrahim Awarda, 15, who lost his father in an Israeli bombardment in 2002, was more fortunate. He decided to cross the fence between Gaza and Israel. "I knew I'd be arrested," he told the New York Times reporter in Gaza last week. "I told myself, maybe I'll find a better life. They gave me good food and then threw me back."


Ibrahim was held for about a month in two prisons in Israel before being tossed back to the destruction, squalor, hunger and death. Three hundred Gazans drowned in the sea last September, in a desperate attempt to leave the prison Strip. Eighty-four Gazans were arrested by the Israel Defense Forces in the last six months after trying to enter Israel, most of them just to flee from the hell they live in. Nine more were arrested this month.


Atiya al-Navhin, 15, also tried to enter Israel in November, just to escape his fate. He was shot by IDF soldiers, treated in two Israeli hospitals and returned to Gaza in January. Now he's lying paralyzed and unable to speak in his home.


Some 150,000 homeless people live in Gaza and about 10,000 refugees in UNRWA shelters. The organization's budget was spent after the world totally ignored its commitment to contribute $5.4 billion to rebuild Gaza. The commitment to negotiate lifting the blockade on Gaza - the only way to avoid the next war and the one after it - has also been broken. Nobody talks about it. It's not interesting. There was a war, Israelis and Palestinians were killed in it for nothing, let's move on to the next war.


Israel will again pretend to be surprised and offended - the cruel Arabs are attacking it with rockets again, for no reason.


Ukraine arms deal with UAE is just NATO backdoor to arm Kiev


The announcement this week that the Kiev regime struck a major deal with the United Arab Emirates for military weapons raises strong suspicions that the US-led NATO alliance has found a new backdoor into Ukraine. We say «new» because it is believed that the US and its NATO allies, Poland and Lithuania, are already covertly supplying weapons to the Kiev regime.

Kiev President Petro Poroshenko hailed the new strategic partnership with the Persian Gulf kingdom while attending the International Defence Exhibition (IDEX) in the UAE capital, Abu Dhabi. Poroshenko, who was royally received by UAE Crown Prince Mohammed bin Zayed al Nayhan, declared himself a «president of peace» but that Ukraine, or rather the rump state that his regime commands, needed strong defence because of its «Russian enemy».


A giveaway to the real significance of the surprise development is that Poroshenko and his Arab hosts also reportedly held discreet meetings with Pentagon officials and US weapons manufacturing executives during the weapons exhibition. That indicates that Washington is coordinating the expected arms transfers.


Although the Kiev-UAE partnership lacked any public detail, one can safely assume that the Arab supply of weapons to Ukraine is simply a conduit for American and NATO military support to the Western-backed junta, which seized power in Ukraine last year in an illegal coup. Its war of aggression on the separatist eastern Ukraine has inflicted at least 6,000 deaths, mainly among the ethnic Russian civilian population.


Earlier this month it soon became clear that Washington and its NATO allies would pay a heavy political price for an audacious move to openly increase their military involvement in the Ukraine conflict. When Washington announced that it intended to go ahead with Congressional provisions to send «lethal aid» to Kiev there was much international consternation over such a reckless move.


Moscow warned Washington that any further military support to the reactionary, anti-Russian Kiev regime on its western border would constitute a «disastrous escalation». US President Barack Obama then appeared to back off from the proposal to supply lethal munitions.


America's normally servile European allies also baulked at the Washington arms move. Germany, France and even Britain indicated disproval by stating that they would not be following suite by sending arms to Ukraine. Germany's Chancellor Angela Merkel was perhaps the most forthright in her reservations. While on an official visit to Washington she reiterated her «no weapons» position to US media while being received in the White House by Obama.


No doubt a disgruntled European public reeling from economic austerity, unemployment and seething contempt for unaccountable EU leaders had a concentrating effect on the various political capitals to not throw more fuel on an already raging Ukrainian fire. The idea of going along with incendiary American militarism in Ukraine and further antagonising Russia would provoke a political storm across Europe. Hence the usually trusty European «yes men» had to defy Washington's recklessness.


That incipient divergence between the US and EU appeared to unnerve Washington, with the latter fearing that its anti-Russian axis and sanctions tactics might be unravelling. President Obama and his Secretary of State John Kerry were at pains to emphasise American-European «unity» over Ukraine and alleged «Russian aggression» - in spite of the fact that European leaders were, publicly at least, repudiating Washington's weapons policy.


So, rather than risking an open split in the NATO ranks, Washington and its allies seem to have found an ingenious way around that problem - by getting the UAE to be the front end for weapons supplied to the Kiev regime.


Several media reports have talked up a «new defence industry» in the UAE. But whatever new industry there may be in the oil-rich kingdom, it is largely a value-adding or marketing platform for established Western manufacturers. The UAE defence sector is dominated by US military imports and American weapons giants, Boeing, Lockheed Martin and Raytheon. The Emirati «partner» operations are a way for the royal rulers to claim kudos for diversifying the kingdom away from its economic dependence on oil exports by seemingly creating hi-tech sectors. For the Western weapons firms, the Arab retail image can provide a convenient public relations cover for global arms-dealing. American and European weapons can thus be sold to parts of the world where it might otherwise be viewed as unethical - thanks to these sales being booked as originating from the UAE.


The fact remains, however, that the United Arab Emirates is the world's fourth biggest arms importer, according to the Stockholm International Peace Research Institute (SIPRI). That is an astounding record considering that the UAE population is some nine million, with only one million of those being Arab nationals, and the rest being expatriate cheap-labour workers from Asia and Africa. Expressed on a per capita basis, the UAE is by far the world's biggest weapons importer. And this is a country that has never been at war since its founding in 1971 after Britain granted formal independence.


In its latest global trends report, SIPRI notes that the Persian Gulf Arab states have doubled their imports of weapons in recent years, from an already high base. Saudi Arabia is now the fifth biggest importer globally. Qatar, Bahrain and Oman are also major sales destinations for the Western arms industry.


The Arab Gulf weapons market is dominated by the US, with some 40 per cent of all sales. Other major exporters to the region are Germany, France and Britain. Russia has also a strong presence in the market. But the lion's share goes to US and its NATO allies. Germany in particular has stepped up its arms exports to the Persian Gulf, which has caused political problems among the German population for the Merkel government as it is being seen to prop up autocratic and repressive regimes. Leopard tanks and armoured personnel carriers are lucrative German exports.


The Persian Gulf arab regimes are thus in effect NATO arsenals. And the tiny UAE with its $13 billion military budget is a NATO arsenal par excellence.


The Kiev regime's new contract with the UAE for military weapons supply is thus a front for NATO supplying weapons to Ukraine. Conveniently for Western governments, the arrangement tends to obscure a NATO link in the eyes of their public, but only superficially.


That bodes badly for the shaky ceasefire that Russia's President Vladimir Putin helped broker earlier this month. Putin has already deprecated the continuing hostile attitude of Poroshenko and other Kiev leaders, who routinely accuse Russia of aggression and talk with bravado of fighting a «total war». Washington and the EU are indulging this inflammatory rhetoric with renewed sanctions on Moscow and laying the blame for the conflict on Russia.


While Western taxpayers bail out the Kiev regime with a $40 billion loan from the International Monetary Fund, the junta is evidently using the money to go on a weapons spree and to crank up its NATO-supplied war machine. The UAE weapons sales deal is just a backdoor for NATO to embark on further warmongering in Ukraine and toward Russia.


The real story on Iran, US, Russia and China

how Iran, the key power in Southwest Asia, is about to be positioned in the nonstop complex ballet between the US, Russia and China. That's one of the key vectors of the New Great Game in Eurasia.

The real story was never about how warmonger Israeli Prime Minister Bibi Netanyahu, a foreign leader, would crudely use the House of Cards, sorry, the US Capitol, as a lowly re-election bully pulpit to mould the US presidency and American foreign policy.


A graphic indication is that while "Bomb Iran" Bibi was distilling his 39-minute harangue in Washington, US Secretary of State John Kerry and Iranian Foreign Minister Javad Zarif were engaged in their third round of nuclear negotiations in Montreux.


The real story is also only partially about this perennial soap opera — the Iranian nuclear dossier. By the end of this month there will be a deadline to reach a framework agreement, and by June - optimistically - a comprehensive final settlement.


What's at stake at the highest level has been known to all major players for ages. Tehran won't settle for anything less than a swift end to the current nasty, illegal package of sanctions. Yet Washington, under the cloud of the self-described "Don't Do Stupid Stuff" Obama administration, keeps changing the goal posts as negotiations advance.


The latest is a demand by Obama for a 10-year suspension of Iranian nuclear activity. Zarif called it "illogical" and "excessive".


Well, as illogical as the trademark paranoia exhibited by the usual basket of US neo-cons and extreme right-wingers. Compare it to how Iran's Supreme Leader Ayatollah Khamenei regards nuclear power - with all its implications; this has also been on the record for ages for anyone to see.


China, Russia and Plan B


Unlike the Cheney regime, the Obama administration seems to have reached a logical conclusion - facilitated by extensive Pentagon gaming; Washington can't destroy Iran's nuclear program - unless it would use nuclear weapons.


Along most of the past decade, that was Plan A. Plan B is the never-ending "negotiations", which boils down to placing a series of restrictions on Iran's nuclear program in exchange for a still very dubious end of sanctions.


Yet the real objective of the Masters of the Universe who control the shadowplay in the Washington/Wall Street axis is to manage imperial decline. That implies, in Southwest Asia, a renewed Divide and Rule push, featuring Turkey, Iran, Saudi Arabia and Israel.


Some key players in Washington are getting increasingly impatient with the House of Saud - what with its low price oil strategy bombing the US shale oil industry. Others worry that Turkey - after a key Pipelineistan deal, the Turk Stream - is moving away to Russia. Thus the option to sort of reintegrate Iran into a collaboration with the West, if not close, at least yielding profitable deals for Western corporations.


Meanwhile, Russia and China are not standing idly, as they are an important part of the P5+1 negotiating team with Iran. Both BRICS nations can - and do — use Iran as leverage in how they negotiate with the hegemon, always finding ways to undermine the US "pivoting to Asia".


As soon as relations with Iran are normalized, Tehran will be admitted to the Shanghai Cooperation Organization (SCO); currently it enjoys observer status. Washington dreads the move - as it will advance Iran's Eurasian integration, and solidify a Moscow-Tehran-Beijing political/commercial axis.


Russia already does very good business with Iran - from nuclear plants to weapons sales. No US deal with Iran will come through without a tacit Russian acquiescence - and the Americans know it. Beijing, for its part, tends to cling to the status quo - as in not desiring Tehran to get any closer to the West because that would mean a freer hegemon in its "pivoting to Asia" mode, which China, correctly, identifies as containment.


Further on down the road, Tehran can use a rapprochement with the West to increase its bargaining power with Beijing. Assuming a deal is reached this summer, Tehran will be in an excellent position to extract concessions - on the economy, security, defense - from its Chinese partners. But the name of the game remains Eurasian integration.


The Caliphate, "our" bastards


As for vociferous Bibi, all he had left was to once again try to sell Washington an Israeli war of choice against a demonized-to-oblivion Iran. It didn't fly - as much as those usual suspects, the AIPAC lobby, bluntly ordered their shock troops to tell the House of Cards, sorry US Congress, that war is peace, and any nuclear deal is a deal with the devil. As argued by Trita Parsi, the real "existential threat" for Bibi is peace.


Once again, the real story here is not a nuclear Iran; it's the possibility of a US-Iran détente where Israel's grip on US foreign policy is not ironclad anymore.


Predictably, Bibi lumped as evil forces lurking in his "neighborhoo" everyone from Iran and "Lebanon" (he meant Hezbollah) to Assad's Syria and Hamas. But not ISIS/ISIL/Daesh. So a non-nuclear Iran is a worse threat to civilization than the fake, beheading-addicted Caliphate.


Espousing such a worldview Bibi would not even qualify as an extra on House of Cards - the one on Netflix. Meanwhile, the real Israel story - the illegal occupation/apartheid imposed on Palestine - continues, obscured by the usual gaggle of somnambulists in the Bibi-raided House of Cards, sorry, US Congress.


Dead humpback whale found off Vietnam coast

Dead humpback whale



According to the family of fisherman Ho Xuan Banh, the owner of the fishing vessel that caught the creature, they were fishing at about 10am on the Gia Cao territorial waters in the southernmost Ca Mau Province, when they found a dead whale entangled in their net.


They immediately stopped all fishing activities, and brought the creature ashore to the Nam Hai Whale's Temple in Ganh Hao Town for worship in accordance with the local rituals.


The Nam Hai Temple managers later confirmed that it was a humpback whale with a blow-hole and a horizontal tail.


The whale was 2.33m long, 1.2m wide and weighed more than 250kg.


A representative from the Nam Hai Temple management board said that after the initial worship rituals, the whale's body will be preserved with chemicals for the worship customs of local residents, and will be exhibited at the temple's display house.


Victoria Nuland's next Coup d'etat: Georgia

"Would you like cookies or bullets with that Coup d'etat?"



Former Georgian president Mikheil Saakashvili has been saying for six months that he will be back in six months! No elections are due to be held and he can't run for president again. Now, unfortunately, we might know what he meant.

On February 17 Victoria Nuland, a US Assistant Secretary of State, visited Tbilisi. She is best known for being an outspoken supporter of the coup d'etat in Kiev a year ago, which led to the violent overthrow of then-president Viktor Yanukovich and the ongoing fighting over this now nearly failed state. She appeared in Tbilisi at the same time Saakashvili officially became an "advisor" to Ukraine's new incumbent, Petro Poroshenko.


Nuland's notoriety as a field-tested battleaxe precedes her. Both she and her husband, Robert Kagan, are products of the Bush-Cheney neo-con regime and are closely linked with its "1984" mindset of conducting continuous war, which was the basis of the defence strategy outlined by the Cheney Defense Department in the waning days of the Bush Administration, the now-notorious "Project for a New American Century".


Nuland and Kagan both subscribe to the old doctrine of "manifest destiny" which this document was based on. According to this, America must remain the undisputed leader of the world, because that is the reason for America's existence. As a diplomat she has been employed to serve America's interests, but, like many official US representatives, she has taken the view that the US interest is the only one, there is no such thing as a general or even broader interest, as her famous "Fuck the EU" remark last year testifies.


In late February Germany's described her as "America's Riot Diplomat"— a sobriquet which can mean both that Nuland acts disruptively, and that she creates actual riots (as on the Maidan in Ukraine). Its "Politics" column stated that Nuland poses a threat to America's allies (including Georgia and Azerbaijan, the countries she has just visited), and that while her current remit is to solve the crisis of Ukraine and its relations with Russia, "In the crisis, Nuland herself has become the problem ."


So why was such a person visiting Georgia and Azerbaijan at the same time former US favourite Saakashvili was taking up a new appointment in Ukraine to prevent him being extradited to face criminal charges in Georgia? As always, there is no coincidence about these things occurring at the same time.


Too many connections


Victoria Nuland is well aware of both Georgian and Ukrainian history, and knows the players or "patsies" now engaged in them. Indeed, she was in Kiev during the Orange Revolution when she was US Ambassador to NATO, banging the drum for regime change. Georgia had already had a similar US-inspired regime change, led by Saakashvili. Now another violent regime change has occurred, but has not gone to plan, Saakashvili is being brought in to advise these new "patsies".


Nuland's position on Ukraine is clear. described a closed-door meeting she held at the Munich Security Conference a week before, involving "perhaps two dozen U.S. diplomats and Senators." She told them to "fight against the Europeans" on the issue of arming Ukraine to fight Russia, referred to the meeting between the leaders of Germany, France and Russia as "Merkel's Moscow junk," and "Moscow bullshit," and welcomed a Senator calling German Defence Minister Ursula von der Leyen the "Defeatism Minister."


Nuland doesn't want an agreement between the warring parties in Ukraine, or to prevent further loss of life. The more Ukraine is in crisis, the more the US, or rather she as its representative, can do what it likes in the name of "regulating" that crisis. That, apparently, includes rehabilitating Saakashvili by making him an "adviser", and therefore a statesman, rather than the wanted criminal he is in the country he was president of.


It is hardly surprising therefore that this open support for a man forced out of Georgia for his many crimes aroused considerable disquiet in Tbilisi during her visit. When pressed about the alleged crimes of the former president she would only answer that Ukraine was in need of expertise and was seeking advice from those who have a proven track record in such situations. It was exactly that track record which got him kicked out of Tbilisi, so such a statement cannot be considered friendly.


The U.S. Department of State claimed her visit was dedicated to discussing "cooperation and regional issues" and "Georgia's path toward European integration and Georgia's efforts to defend its territorial integrity and sovereignty." In English, this means ensuring that Georgia cooperates with the US on Ukraine by threatening it with being barred from entering the EU and losing Abkhazia and South Ossetia forever if it doesn't. Open support for Saakashvili is all part of the same threat.


Devil in the detail


After visiting Tbilisi Nuland travelled to Baku, to "strengthen bilateral relations in trade and investment, energy diversification, security and counter-terrorism and democracy and civil society, and advancing a just and lasting settlement of the Nagorno-Karabakh conflict." Note the similarity of language. The US will help Azerbaijan, and ignore its own misdemeanours, if it supports it over Ukraine. If not, it will sign Karabakh over to Armenia, without consulting Azerbaijan.


It was reported that Nuland held meetings with the NGOs allowed to operate in both countries. The vast majority of these are funded by the Soros Foundation and the National Endowment for Democracy, NED, which have long been CIA fronts for toppling regimes which fail to toe-the American-foreign-policy-line. See where they operate, and where the funds go, and an undeniable picture emerges.


While this was going on Saakashvili was holding meetings with his supporters via a big screen link at his Presidential Library in Tbilisi, the only such institution in Georgia. A number of youth orientated NGOs regularly attend these meetings, including the Innovations and Development Foundation, The Movement for Independence and European Integration, Free Zone and the newly created Azat Zone (a Georgian-Azerbaijani venture) and the League of Young Diplomats,. These are all standard bearers for keystone Saakashvili policies.


Unfortunately, there are a number of governments around the world who would wish to benefit from Saakashvili's experience of running criminal networks which robbed, terrorised, tortured and murdered Georgians for so long. However Saakashvili and several prominent members of his regime are being protected by the latest US project, and walking into jobs in its government, despite not being Ukrainian or elected.


It is also interesting that the US is saying that the present Georgian government is deviating from the country's Pro-Western course by trying to prosecute the Saakashvili gang. This is exactly what the protestors in Ukraine were alleged to be complaining about, when they were doing nothing of the sort. The implication is that Saakashvili, rather than the new government, represents the aspirations of the people. So what, are we left to imply, should be done by a caring global policeman?


Too many rumours


All the ducks are in a row for another attempt at "pro-Western" regime change by "popular uprising", like the failed Orange Revolution and the faltering Chocolate War. All Saakashvili's many attempts to hold demonstrations in his favour since he left office have shown the Georgian people do not want him. But if the present Georgian government will not do what America wants in Ukraine, that is what it is going to get.


Indeed, there have been persistent rumours in Georgia over the last few weeks that some regime change may be in the works. These have been openly reported in the Georgian media, as if trying to prepare the public for what others say is good for them. Another of the usual telltale signs, the sudden increase in the number of overseas military advisors entering the country, has been observed by sources at the Tbilisi airport.


The former Georgian government people now in Ukraine have strong connections with the National Endowment for Democracy and Soros Foundation-funded NGOs. These are the people Nuland met and briefed in Georgia and Azerbaijan. She could have met other people, like the electors or independent media, but she was interested in these individuals and their network. As the State Department unwittingly acknowledged, she wasn't there to hear but to tell.


Jeffrey Silverman, Bureau Chief in Tbilisi, recently said the following in an interview in a Georgian language newspaper, Georgian and the World:


"A representative of a foreign intelligence service, who also represents a NATO country, at least I suspect so, suggested that Vakhtang Maisaia, one of Saakashvili's former political prisoners and a high profile human rights defender, should disappear for a while, as he had information that he was on some sort of hit list, and was among those to be killed as part of a plot to overthrow the current government.


"Based on 'strong rumors' going around which, based on previous experience, are very credible, some diehard members of the former ruling United National Movement and high ranking members of the current government have been plotting together to stage a coup d'etat. There will be some "nice ceremonies and private parties" for a selection of participants, and as my contact sees it, Vakhtang Maisaia will be one of the guests to be terminated.


"My source added, 'I am sorry for being so enigmatic, but this is something scalding and it's easy to get burnt with it. I wish you the best of luck and I kindly ask you not to mention the topic via email anymore. If you find documents but need clarifications, download software called Jitsi from a clean computer and let's have a chat through it.


"The world has gone nuts, there is an investigation going on within Georgia. I am sure you know what I am talking about, but plz do not add anything via email - it is encrypted, but not bulletproof. If you find the right door to knock on in Tbilisi, I think you will get all the evidence you need. Whether that information can be published or not depends on the politicians in power and how fearless is the Georgian press," he concluded.


This is what the Guardian democracy does when its friends elect their own government. Time will tell whether that government caves in, or whether a popular uprising by 20 Georgians and 50 diplomats installs one which will.

Study finds Aboriginal legends linked with cyclical cosmic catastrophes

Dr Duane Hamacher from the UNSW Indigenous Astronomy Group has uncovered evidence linking Aboriginal stories about meteor events with impact craters dating back some 4,700 years.


Dr Hamacher, an astrophysicist studying Indigenous astronomy, examined meteorite accounts from Aboriginal communities across Australia to determine if they were linked to known meteoritic events.


His study, published in the latest edition of peer-reviewed journal Archaeoastronomy, found "definitive links" between known meteorite craters and local Aboriginal traditions.


One of the meteorite strikes, at a place called Henbury in the Northern Territory, occurred around 4,700 years ago.


Dr Hamacher said the level of detail contained in the local oral traditions suggested the Henbury event had been witnessed and its legend passed down through generations over thousands of years - a remarkable record.


"Aboriginal men refused to go near the cluster of craters, claiming it was where the fire-devil ran down from the sun, hit the ground, and killed everyone. The fire-devil burned the people for breaking sacred law," said Dr Hamacher.


"There are similar stories in Aboriginal traditions across Australia of fiery stars falling from the sky, producing a deafening sound, blowing debris across the land and setting the ground on fire."


In some instances Dr Hamacher said stories by Aboriginal people led to the discovery of meteorites by local settlers.


For example, in 1855 a farmer found a 32kg octahedrite near Stockinbingal in the NSW Riverina after local Aboriginal tales of a yeo-yeo or devil led him there.


"Aboriginal oral traditions contain detailed knowledge about the natural world. These include stories about rare events like tsunamis, earthquakes, volcanic eruptions, meteorite impacts and solar eclipses," Dr Hamacher said.


"By merging scientific data with descriptions in oral tradition we can show that many of the stories are accounts of real-life events. So Aboriginal stories could lead us to places where natural disasters occurred."


Dr Hamacher said his findings challenged the view that oral traditions only last a few generations.


"The story of Henbury is an example of an oral tradition that was passed down more than 200 generations. This is important evidence for social scientists studying oral traditions."

How Many Constitutional Freedoms Have We Lost?

This post explains the liberties guaranteed in the Bill of Rights - the first 10 amendments to the United States Constitution - and provides a scorecard on the extent of the loss of each right.


First Amendment


The 1st Amendment protects speech, religion, assembly and the press:



Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.



The Supreme Court has also interpreted the First Amendment as protecting freedom of association.

However, the government is arresting those speaking out... and violently crushing peaceful assemblies which attempt to petition the government for redress.


A federal judge found that the law allowing indefinite detention of Americans without due process has a "chilling effect" on free speech. And see this and this.


There are also enacted laws allowing the secret service to arrest anyone protesting near the president or other designated folks (that might explain incidents like this).


Mass spying by the NSA violates our freedom of association.


The threat of being labeled a terrorist for exercising our First Amendment rights certainly violates the First Amendment. The government is using laws to crush dissent , and it's gotten so bad that even U.S. Supreme Court justices are saying that we are descending into tyranny. (And the U.S. is doing the same things that tyrannical governments have done for 5,000 years to crush dissent.)


For example, the following actions may get an American citizen living on U.S. soil labeled as a "suspected terrorist" today:


And holding the following beliefs may also be considered grounds for suspected terrorism: And see this. (Of course, Muslims are more or less subject to a separate system of justice in America.)

And 1st Amendment rights are especially chilled when power has become so concentrated that the same agency which spies on all Americans also decides who should be assassinated.


Second Amendment


The 2nd Amendment states:



A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.



Gun control and gun rights advocates obviously have very different views about whether guns are a force for violence or for good.

But even a top liberal Constitutional law expert reluctantly admits that the right to own a gun is as important a Constitutional right as freedom of speech or religion:



Like many academics, I was happy to blissfully ignore the Second Amendment. It did not fit neatly into my socially liberal agenda.

It is hard to read the Second Amendment and not honestly conclude that the Framers intended gun ownership to be an individual right. It is true that the amendment begins with a reference to militias: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." Accordingly, it is argued, this amendment protects the right of the militia to bear arms, not the individual.


Yet, if true, the Second Amendment would be effectively declared a defunct provision. The National Guard is not a true militia in the sense of the Second Amendment and, since the District and others believe governments can ban guns entirely, the Second Amendment would be read out of existence.

More important, the mere reference to a purpose of the Second Amendment does not alter the fact that an individual right is created. The right of the people to keep and bear arms is stated in the same way as the right to free speech or free press. The statement of a purpose was intended to reaffirm the power of the states and the people against the central government. At the time, many feared the federal government and its national army. Gun ownership was viewed as a deterrent against abuse by the government, which would be less likely to mess with a well-armed populace.


Considering the Framers and their own traditions of hunting and self-defense, it is clear that they would have viewed such ownership as an individual right — consistent with the plain meaning of the amendment.


None of this is easy for someone raised to believe that the Second Amendment was the dividing line between the enlightenment and the dark ages of American culture. Yet, it is time to honestly reconsider this amendment and admit that ... here's the really hard part ... the NRA may have been right. This does not mean that Charlton Heston is the new Rosa Parks or that no restrictions can be placed on gun ownership. But it does appear that gun ownership was made a protected right by the Framers and, while we might not celebrate it, it is time that we recognize it.



The gun control debate - including which weapons and magazines are banned - is still in flux...

Third Amendment


The 3rd Amendment prohibits the government forcing people to house soldiers:



No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.



A recent lawsuit by a Nevada family - covered by (Mother Jones , Fox News and Courthouse News - alleges violation of the Third Amendment.

Moreover, the military is arguably quartering "digital" troops within our homes.


Fourth Amendment


The 4th Amendment prevents unlawful search and seizure:



The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.



But the government is spying on everything we do ... without any real benefit or justification.

Indeed, experts say that the type of spying being carried out by the NSA and other agencies is exactly the kind of thing which King George imposed on the American colonists ... which led to the Revolutionary War.


And many Constitutional experts - such as Jonathan Turley - think that the police went too far in Boston with lockdowns and involuntary door-to-door searches.


Fifth Amendment


The 5th Amendment addresses due process of law, eminent domain, double jeopardy and grand jury:



No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.



But the American government has shredded the 5th Amendment by subjecting us to indefinite detention and taking away our due process rights.

The government claims the right to assassinate or indefinitely detain any American citizen on U.S. citizen without any due process . And see this.


For example, American citizens are being detained in Guantanamo-like conditions in Chicago ...

including:



  • Being held in secret



  • Not even telling a suspect's lawyer whether his client is being held?


And see this, this and this.

As such, the government is certainly depriving people of life, liberty, or property, without due process of law.


There are additional corruptions of 5th Amendment rights - such as property being taken for private purposes . And the right to remain silent is gone .


The percentage of prosecutions in which a defendant is denied a grand jury is difficult to gauge, as there is so much secrecy surrounding many terrorism trials.

Sixth Amendment

The 6th Amendment guarantees the right to hear the criminal charges levied against us and to be able to confront the witnesses who have testified against us, as well as speedy criminal trials, and a public defender for those who cannot hire an attorney:



In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.



Subjecting people to indefinite detention or assassination obviously violates the 6th Amendment right to a jury trial. In both cases, the defendants are "disposed of" without ever receiving a trial ... and often without ever hearing the charges against them.

More and more commonly, the government prosecutes cases based upon "secret evidence" that they don't show to the defendant... or sometimes even the judge hearing the case.


The government uses "secret evidence" to spy on Americans, prosecute leaking or terrorism charges (even against U.S. soldiers) and even assassinate people. And see this and this.


Secret witnesses are being used in some cases. And sometimes lawyers are not even allowed to read their own briefs.

Indeed, even the laws themselves are now starting to be kept secret . And it's about to get a lot worse .

Moreover, government is "laundering" information gained through mass surveillance through other agencies, with an agreement that the agencies will "recreate" the evidence in a "parallel construction"... so they don't have to admit that the evidence came from unconstitutional spying. A former top NSA official says that this is the opposite of following the Fourth Amendment, but is a "totalitarian process" which shows that we're in a "police state".


And there are two systems of justice in America ... one for the big banks and other fatcats, and one for everyone else. The government made it official policy not to prosecute fraud , even though fraud is the criminal fraud is the main business model adopted by Wall Street. Indeed, the giant banks.


The perpetrators of the biggest financial crime in world history , the largest insider trading scandal of all time , illegal raiding of customer accounts and blatant financing of drug cartels and terrorists have all been committed recently without any real criminal prosecution or jail time.


On the other hand, government prosecutors are using the legal system to crush dissent and to silence whistleblowers.


And some of the nation's most powerful judges have lost their independence ... and are in bed with the powers-that-be.


Seventh Amendment


The 7th Amendment guarantees trial by jury in federal court for civil cases:



In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.



But there are two systems of justice in America ... one for the big banks and other fatcats, and one for everyone else. So good luck going after the powers-that-be.

And the World Justice Project - a bipartisan, independent group with honorary chairs including numerous current and former Supreme Court Justices - released a report saying that Americans have less access to justice than most wealthy countries ... and many developing nations. The report finds that Americans have less access to justice than Botswanans, and that only the wealthy have the resources to protect rights using the court system:

For example, Germans sue equally whether they are rich or poor ... but in America, only the wealthy have the resources to protect rights using the court system:

And the austerity caused by the highest levels of inequality in world history - which are in turn is caused by socialist actions by our government, which have destroyed the Founding Fathers' vision of prosperity - is causing severe budget cuts to the courts, resulting in the wheels of justice slowing down considerably.

Finally, federal judges have recently decided that they can pre-judge cases before the plaintiff even has the chance to conduct discovery ... and throw cases out if they don't like plaintiff's case.


Eighth Amendment


The 8th Amendment prohibits cruel and unusual punishment:



Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.



Indefinite detention and assassination are obviously cruel and unusual punishment.

The widespread system of torture carried out in the last 10 years - with the help of other countries - violates the 8th Amendment. Many want to bring it back ... or at least justify its past use.


While Justice Scalia disingenuously argues that torture does not constitute cruel and unusual punishment because it is meant to produce information - not punish - he's wrong. It's not only cruel and unusual ... it is technically a form of terrorism .


And government whistleblowers are being cruelly and unusually punished with unduly harsh sentences meant to intimidate anyone else from speaking out.


Ninth Amendment


The 9th Amendment provides that people have other rights, even if they aren't specifically listed in the Constitution:



The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.



We can debate what our inherent rights as human beings are. I believe they include the right to a level playing field, and access to non-toxic food and water. You may disagree.

But everyone agrees that the government should not actively encourage fraud and manipulation. However, the government - through its malignant, symbiotic relation with big corporations - is interfering with our aspirations for economic freedom, safe food and water (instead of arsenic-laden, genetically engineered junk), freedom from undue health hazards such as irradiation due to government support of archaic nuclear power designs, and a level playing field (as opposed to our crony capitalist system in which the little guy has no shot due to redistribution of wealth from the middle class to the super-elite, and government support of white collar criminals).


By working hand-in-glove with giant corporations to defraud us into paying for a lower quality of life, the government is trampling our basic rights as human beings.




Tenth Amendment

The 10th Amendment provides that powers not specifically given to the Federal government are reserved to the states or individual:



The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.



Two of the central principles of America's Founding Fathers are:

(1) The government is created and empowered with the consent of the people


and


(2) Separation of powers



Today, most Americans believe that the government is threatening - rather than protecting - freedom. We've become more afraid of our government than of terrorists, and believe that the government is no longer acting with the "consent of the governed ".

And the federal government is trampling the separation of powers by stepping on the toes of the states and the people. For example, former head S&L prosecutor Bill Black - now a professor of law and economics - notes:



The Federal Reserve Bank of New York and the resident examiners and regional staff of the Office of the Comptroller of the Currency [both] competed to weaken federal regulation and aggressively used the preemption doctrine to try to prevent state investigations of and actions against fraudulent mortgage lenders.



Indeed, the federal government is doing everything it can to stick its nose into every aspect of our lives... and act like Big Brother.

Conclusion: While a few of the liberties enshrined in the Bill of Rights still exist, the vast majority are under heavy assault.


Other Constitutional Provisions ... and The Declaration of Independence


In addition to the trampling of the Bill of Rights, the government has also trashed the separation of powers enshrined in the main body of the Constitution.


The government is also engaging in activities which the Founding Fathers fought against, such as taxation without representation (here and here), cronyism, deference to central banks, etc.


As the preamble to the Declaration of Independence shows, the American government is still carrying out many of the acts the Founding Fathers found most offensive:



He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures. [Background here and here]


He has affected to render the Military independent of and superior to the Civil power. [Background here, here, here, here and here]

He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation: [Background]
